Terms of Service
These terms cover your use of Postuva: your account, your content, connected networks, acceptable use, subscriptions and cancellation. How we handle personal data is explained in the Privacy Policy.
1. Agreement
These terms are an agreement between you and Postuva (“Postuva”, “we”, “us”) for your use of Postuva at postuva.com and its apps (the “Service”). By creating an account or using the Service you agree to them. If you use the Service on behalf of an organisation, you confirm you can bind that organisation to these terms.
2. Your account
- You must be at least 16 years old and give accurate information when you sign up.
- Keep your password secure. You're responsible for activity in your account and in workspaces you own, including actions by team members you invite.
- Tell us promptly at support@postuva.com if you think your account has been accessed without permission.
3. Connected social networks
The Service publishes to third-party networks (such as Instagram, Facebook, TikTok, YouTube, LinkedIn and X) using access you grant. Your use of each network remains subject to that network's own terms and policies, including the YouTube Terms of Service. Networks can change or withdraw their APIs, limit what can be posted, or delay or refuse posts; we're not responsible for their decisions, and we can't guarantee that every scheduled post will be published.
You confirm that you're allowed to connect each account and post to it, and you can disconnect any account at any time.
4. Your content
You keep all rights to the posts and media you create or upload. You give Postuva a limited licence to store, process, adapt (when you use the AI features) and transmit that content only as needed to provide the Service to you, for example uploading it to the networks you choose.
You're responsible for your content and confirm that you have the rights to publish it and that it doesn't break the law or any network's rules.
5. AI features
AI-generated versions of your posts are suggestions. They're designed to keep to the facts you provide, but they can contain mistakes. Review AI output before it's published; you're responsible for what's posted from your account.
6. Acceptable use
You must not use the Service to:
- post spam, mass unsolicited messages or the same content repeatedly in ways networks prohibit;
- publish content that is illegal, infringes others' rights, harasses people, or promotes violence or hatred;
- manipulate engagement (fake accounts, vote or follower schemes) or evade a network's restrictions or bans;
- access other people's accounts without permission, or attempt to break, overload, scrape or reverse-engineer the Service.
7. Plans, billing and cancellation
- The Free plan is free with the limits shown on the pricing page. Paid plans (Creator, Pro and Agency, from $15 a month) are billed in US dollars in advance, monthly or yearly, through our payment provider Paystack.
- Subscriptions renew automatically at the end of each period until you cancel. You can cancel at any time from the Billing page; your plan stays active until the end of the period you've paid for and then returns to Free.
- Payments are non-refundable except where the law requires otherwise, or where we decide to issue a refund. If you're a consumer in the EU or UK and want to withdraw within 14 days of your first payment, email us and we'll refund you.
- We may change prices with at least 30 days' notice by email. New prices apply from your next renewal; you can cancel before then.
- If a renewal payment fails, we may move your workspace to the Free plan after a reasonable grace period.
8. Availability and changes
We work to keep the Service available and reliable, but it's provided “as is” and “as available”. We may change, add or remove features. If we discontinue the Service, we'll give paid customers at least 30 days' notice and a pro-rated refund for unused prepaid time.
9. Suspension and termination
You can stop using the Service and delete your account at any time from Settings. We may suspend or close accounts that break these terms, put the Service or other users at risk, or are required to be closed by law. Where reasonable, we'll tell you first and give you a chance to fix the problem.
10. Liability
To the extent the law allows, we're not liable for indirect or consequential losses, lost profits, lost data, or for posts that a network delays, rejects or removes. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim, or $100 if that's higher.
Nothing in these terms limits liability that can't be limited by law, such as liability for fraud, or for death or personal injury caused by negligence, or your statutory rights as a consumer.
11. Indemnity
If you use the Service for a business, you agree to cover our reasonable costs from claims made against us because of your content or your breach of these terms.
12. Governing law
These terms are governed by the laws of the country where the operator of the Service is registered. If you're a consumer, you also keep the protection of the mandatory laws of the country where you live and can bring claims there.
13. Changes to these terms
We may update these terms. For material changes, we'll email account owners at least 30 days before they take effect. If you keep using the Service after that, the new terms apply.
